Selling homemade food in Georgia
Georgia dramatically deregulated cottage food in 2025: HB 398 eliminated the state license, the old $5,000 sales cap, and even opened the door to wholesale/retail/restaurant sales. A one-time food safety course and correct labeling are still required. Because this is a recent change, double-check current status with the Department of Agriculture before relying on it.

- Direct in-person sales from home
- Farmers markets & festivals
- Roadside stands
- Online sales with delivery/pickup
- Wholesale, retail store & restaurant sales (newly allowed under HB 398)
Selling online
Online ordering is permitted; as of HB 398 (2025), products may also be sold wholesale to retailers and restaurants — a major change from the prior direct-to-consumer-only rule. Confirm current specifics with the GA Dept. of Agriculture, since this law changed recently and some agency materials may lag the update.
What your labels must include
- Business name, address & phone number
- Ingredient list
- Allergen declaration
- Net weight
- "MADE IN A COTTAGE FOOD OPERATION THAT IS NOT SUBJECT TO STATE FOOD SAFETY INSPECTIONS" statement (min. 10-point type, Times New Roman or Arial, contrasting color)
