Selling homemade food in Nebraska

Nebraska is one of the friendliest states for home food sellers: a free one-time registration (plus a short food safety course) with no fee or inspection, and no cap on how much you can earn. A 2024 law expansion (LB 262) even opened the door to select TCS items like ice cream, cheese, cheesecake, and pudding made with pasteurized dairy.

Registration
Free one-time registration with Nebraska Dept of Agriculture (no fee, no inspection); producer must also complete an approved food safety course (e.g., ServSafe, StateFoodSafety, or UNL Cottage Food Law Training). Producers selling only non-TCS foods directly at farmers markets are exempt from registration.

You can sell

  • Baked goods
  • Jams, jellies, preserves
  • Candy
  • Dried herbs & seasoning mixes
  • Some TCS foods (ice cream, cheese, cheesecake, pudding made with pasteurized dairy) under the LB 262 expansion

You can't sell

  • Raw meat, poultry, or other animal byproducts
  • Raw milk/dairy and raw eggs
  • Unpasteurized juice
  • Infused oils or infused honey
  • Sprouts
  • Low-acid canned or hermetically sealed acidified foods
  • Tofu, tempeh, and meat substitutes
  • Kimchi, kombucha, and other fermented foods

Where you can sell

  • Direct to consumer at home (pickup or producer delivery)
  • Farmers markets, fairs, festivals, and craft shows
  • Online orders with in-state pickup or delivery
  • U.S. mail or commercial carrier delivery (non-TCS foods only)

Selling online

Online ordering for in-state pickup or delivery is allowed; non-TCS (shelf-stable) foods may also be shipped by U.S. mail or commercial carrier. TCS foods sold this way must stay within Nebraska Pure Food Act temperature/time limits (max 2 hours in transit) and cannot be shipped by mail. No interstate shipping.

What your labels must include

  • Producer name & specific mailing address
  • Required disclosure statement (see below)
  • Ingredient list in descending order by weight
  • Allergen disclosure
  • Net weight
