Selling homemade food in Tennessee
Tennessee's Food Freedom Act is about as hands-off as it gets - no permit, no license, no cap, and a 2025 update even added some poultry and dairy products. You can sell and ship within Tennessee freely, just don't ship across state lines since that triggers federal rules.

You can't sell
- Sales requiring FDA-regulated interstate commerce (out-of-state shipping not protected)
Where you can sell
- Direct to consumer
- Farmers markets
- Online with in-state shipping/delivery
- Retail stores (non-perishable items)
Selling online
Online orders and in-state shipping are allowed; once a package crosses state lines it falls under FDA rules and is no longer protected by this law
What your labels must include
- Producer name & address
- "This product is homemade and not inspected by a health department" statement
- Ingredient list
- Allergen disclosure
- Net weight
