Selling homemade food in Wyoming

Wyoming was the first state in the nation to pass a Food Freedom Act, and it's still one of the most generous: no license, no inspection, and a sales cap of $250,000/year gross revenue. You can take orders online, but every sale has to end with an in-person pickup or delivery inside Wyoming - no shipping. Sellers must still verbally or in writing inform buyers that the food is uninspected and unregulated.

Selling online

You can advertise and even take orders online, but products cannot be shipped - pickup or hand delivery within Wyoming only. Note: as of mid-2026 a legislative committee bill was under discussion that could extend the Act to restaurant/coffee-shop sales, but it has not passed.

What your labels must include

Producer name & address
Statement that the food is "not certified, labeled, licensed, packaged, regulated or inspected" per Wyo. Stat. 11-49-103
